LIMITED WARRANTIES
Moisture Loc stands behind the systems and services installed under this Agreement through a series of limited warranties; in general, waterproofing and drainage systems are designed and warranted to manage water intrusion for the life of the structure when properly installed and maintained; mechanical components are covered for stated time periods or under manufacturer warranties, and certain specialty or trade services carry shorter-term workmanship warranties; each warranty is subject to the specific conditions, limitations, and exclusions set forth below.
1. General Warranty Conditions. All warranties apply only to systems and components installed by MLI as defined in the Proposal and are conditioned upon full payment; all systems must be properly operated and maintained; warranties are void if Customer remains in default beyond fifteen (15) calendar days unless otherwise agreed in writing; warranties are also void if any installed system or surrounding structure is altered, penetrated, or repaired by others without MLI’s written approval; warranty remedy is limited to repair or replacement of defective work or materials; MLI is not responsible for incidental or consequential damages; mechanical and electrical devices, including sump pumps and dehumidifiers, are covered solely by applicable manufacturer warranties unless expressly stated otherwise; no employee or representative may modify these warranties except in writing.
2. GreenSpace™ Crawl Space System Limited Warranty. GreenSpace™ liner material will be free from holes or tears for the life of the structure; groundwater will not collect above the liner where a full interior drain and sump pump system is installed by Moisture Loc; relative humidity will average below 65% where a dehumidifier is installed by MLI; Exclusions. Damage from abuse, alterations, or work by others; systems conditioned by HVAC; failure or interruption of power or mechanical systems; conditions caused by exterior drainage, groundwater, or site conditions outside installed system scope; Conditions. Interior drain and sump pump must be operational; exterior drainage systems must be functional; all mechanical and electrical systems must be properly installed and maintained; fuel-fired appliances must be direct vent and professionally installed.
3. Dehumidifier Limited Warranty. Dehumidifier installed by MLI is warranted for five (5) years for parts and labor.
4.Sump Pump Limited Warranty. Sump pump installed by MLI is warranted for three (3) years for parts and labor.
5. 16 Mil Moisture Barrier Limited Warranty. 16 mil moisture barrier installed by MLI is warranted against rips and tears for a period of fifteen (15) years; Conditions. Must be protected from abuse, alteration, or damage by others.
6. Mold Services Limited Warranty. Where MLI performs full mold remediation in conjunction with installation of a closed crawlspace system with dehumidifier, MLI warrants against visible fungal growth recurrence in treated areas resulting from humidity within the installed system; in the event of recurrence, MLI may retreat affected areas as needed. Conditions. Customer must contract with MLI for annual maintenance and inspections at additional cost to maintain this warranty; all systems, including drainage, encapsulation, and dehumidification components, must remain operational and maintained. Exclusions.No warranty applies to fungal growth resulting from plumbing leaks, mechanical or HVAC systems, acts of God, exterior water intrusion, conditions outside MLI’s control, or untreated areas; no warranty is provided where partial remediation or wipe-down is performed, where Customer elects to install non-MLI systems, or where crawlspace vents remain open. MLI does not identify or warrant any mold or fungal species, and no warranty is based on air sampling or independent testing results unless expressly stated in writing. This warranty applies only to wood surfaces treated by MLI, including joists and subflooring, and does not apply to other non-wood surfaces.
7. Interior Drain System Limited Warranty. Basement interior pipe and stone drain systems installed by MLI are warranted for the life of the structure to eliminate standing water; Conditions. All drain lines must be free and clear; sump pump and sump pump discharge must be operational.
8. Exterior Waterproofing Limited Warranty. Exterior waterproofing system installed by MLI is warranted for the life of the structure to eliminate below-grade water seepage where properly applied; Conditions. Waterproofing material must extend above existing grade; all drain lines must be free and clear; sump pump and discharge, if required, must be operational; Exclusions. No warranty applies to drain lines installed or modified by others; no warranty is provided for soil settlement, landscaping survival, or restoration following excavation.
9. Interior Foundation Water Management System Limited Warranty. Interior foundation water management system installed by MLI is warranted for the life of the structure to manage water intrusion on existing foundation walls due to below-grade water seepage; Conditions. All drain lines must be free and clear for the system to perform as intended; where a sump pump is installed, the pump and discharge must be operational; Exclusions. Failure of sump pump or mechanical components is not covered except for improper installation by MLI or an approved MLI applicator.
10. Helical Pier Limited Warranty. Helical pier system installed by MLI is warranted for the life of the structure for workmanship and materials; Conditions.Installation must be performed in accordance with a licensed engineer’s stamped design; Exclusions. Performance or structural movement not related to improper installation is subject to evaluation and direction by the engineer of record; where failure results from improper installation by MLI, MLI will perform repairs as directed by the engineer.
11. Wall Anchor Limited Warranty. Wall anchor system installed by MLI is warranted for a period of twenty-five (25) years to stabilize foundation walls where installed; straightening of foundation walls is not guaranteed; Conditions. System may require periodic tightening to perform as intended; Customer is responsible for scheduling maintenance.
12. Wood Repair Limited Warranty. Structural wood repairs performed by MLI are warranted for workmanship for one (1) year from completion and will be completed in compliance with applicable building codes and permitting requirements; perfect floor leveling is not guaranteed and may not be attainable due to existing structural conditions; cosmetic impacts may occur during lifting or repair work, including cracking of drywall or tile, and cosmetic repairs are the responsibility of the Customer. Conditions. Where damage is caused by MLI’s proven negligence, MLI will repair such damage to a like condition; if the parties cannot agree on the cause of damage, a third-party evaluation may be used to determine responsibility. Exclusions. Cosmetic damage not resulting from MLI’s proven negligence is not covered.
13. Carbon Fiber Strap Limited Warranty. Carbon fiber strap system installed by MLI is warranted for a period of twenty-five (25) years to stabilize foundation walls where installed.
14. Carbon Fiber Stitch Weld Limited Warranty. Carbon fiber stitch weld repairs are warranted for a period of five (5) years for workmanship.
15. Poly Slab Lifting Limited Warranty. Residential concrete flatwork (excluding foundations) lifted with geotechnical polyurethane foam is warranted not to settle more than one-quarter (1/4) inch within five (5) years; if settlement occurs, MLI will provide labor and materials to lift the concrete one (1) additional time; Conditions. Customer must maintain proper grade and drainage; polyurethane must not be left exposed to UV conditions or warranty coverage will be voided; Exclusions. No warranty applies to settlement caused by improper drainage, discharge from downspouts, heavy vehicle loading, plumbing leaks, or conditions outside system control; concrete cracking may occur and is not covered.
16. Joint and Crack Sealant. Silicone joint and crack sealants are provided without warranty.
17. Trade Services Limited Warranty. Electrical, masonry, demolition, and finished rebuild work performed by MLI or its approved subcontractors are warranted against workmanship defects for one (1) year from installation; plumbing and HVAC services are warranted for sixty (60) days in the repaired area only.
